About -- approximately two months ago, Tyler came to the store, and I helped him out. He had a guitar that he wanted repaired. The full context is that he told me that this guitar wouldn't pass a signal. He wanted that repaired. That's very easy, so I, kind of, sent him on his way, wrote up the repair order. Part of our store policy is to test equipment before submitting for a repair order, so I took his guitar and I tested it, and it actually worked just fine. I tried to contact him. Our store was going to be closing within the hour of me contacting him. I couldn't get through on the store phones. I finally tried off my cell phone. I was able to get through to him. Called him back in. He came in, I sat down, and I showed him that it worked, and he was absolutely livid. Customer interactions can be hairy on a day-to-day basis, so I wished him well. He went on his way. I was informed about a month after that that he had been uploading YouTube videos naming me and -- very disparaging content that he's been posting online about me and the company. He's escalated and escalated to the point where -- today is my day off. I received a call from my boss this morning that he had people phoning the store to try to file complaints that I've been harassing him online. So over the course of the two months since this incident, I'm not sure why he has the impression that I've been interacting with him online because I haven't, but he's escalated and escalated and now has other people phoning the store to harass me and us on his behalf. I know that he visits the store on my days off. I've not seen him in the store myself since the incident, but I've also been informed of similar patterns of behaviour from stores -- other Long & McQuade stores across the country by him as well as somebody who informed me of some kind of violent allegations towards Tyler from a domestic partner. And with everything escalating at the rate that it has been and in the manner that it has been, including him claiming to have been filing lawsuits against me, I thought that a protective order would be the most appropriate course of action.

Okay. I'm just going to back up a little bit. You indicated that he finally came back to the store after you had phoned him and you showed him that his guitar worked fine. He was livid about what?

That -- he claimed that it still didn't work, so I -- I was sitting with his electric guitar plugged into my amp, playing it to show him there's no problem. It actually works just fine, maybe you're using the wrong cable or some of the wrong equipment, and he got really angry, accused me of -- essentially, accused me of fixing the guitar but lying to him about fixing the guitar. But then in these videos and in the complaints that he's tagging myself and the company in, he claims that the guitar was broken all along and still broken once I gave it to him and that we never repaired it. Another location actually, just to quell what was going on, allowed him to -- to just return his guitar to their store, and they -- they've actually wrote up a repair order to -- to satisfy him because he claims that it was still broken. So, yes, all of this stems from that one incident. The allegations are that I have -- I -- I treated him in a discriminatory manner based on race, and I'm -- I'm just not sure if he's, I guess, interpreting the same reality that I am, and that's the -- the root of a lot of my concern for my well-being right now.

Well, again, you know, showing and displaying that the guitar was in working order only to have him phoning my -- actually, the -- the head of the company the next day to complain that the guitar was still broken. You know, I -- I finally -- he's been tagging me in posts on LinkedIn for the last couple of months. I never look at LinkedIn, so I looked at it the other day and found all of these posts. And I -- I finally interacted with him, and I just let him know that I -- I haven't been, you know, in contact with him online, and his response was to post my IP address in the comments. I'm not a very technologically inclined person, so I'm not sure how those are found or how easy or difficult it is to find information like that. But to get back to your question, my response to him was, Why -- why are you posting that? You know, this doesn't address what we're talking about, and -- and then it's just on to the next kind of thing, Oh, you don't know what you have coming. Oh, you know -- and I'm like, I'm not sure what -- copying and pasting my IP address is not really a response to my question I asked, and from my colleagues as well, you know, that tends to be the -- the line of communication with this gentleman is that, you know, a question is asked and the answer is -- it never logically follows the question being asked.

I replied in the comments to the post, once I saw that he tagged me in it, just saying, Hey, I haven't interacted with you online. And then he posted my IP address in response, saying, Yes, you have. And I said, I'm not sure what my IP address proves.

I -- you know what, I -- I -- in good faith, I have to believe it was because I know that he is a very technologically proficient person.

He does IT and coding for a living. So, again, in good faith, I'm just, kind of, assuming that it was my IP address. I'm not sure whether it was or not.

Yeah. Last night, he logged into my LinkedIn account.

LinkedIn has a feature that shows you your viewers of your profile. The only viewer that my profile has ever logged is him, and I was trying to go onto LinkedIn last night to document some of these comments, knowing I wanted to come here today and discuss this. I wasn't able to get in. I had to resubmit some government-issued ID, and things like that, in order to get access again, and then once I had access, the message that I received, which I have a screenshot of, says that there was suspicious activity and login attempts on my account that weren't mine. I have to deduce that it could only be Tyler.

Okay. Okay. So -- and what are the YouTube videos that he's uploading? Is it just him?

A lot of it is just him. He has -- there's -- so the -- the form of the YouTube videos have been that they are YouTube Shorts, and he films himself. He names me, my full legal name, and the store that I work at, Long & McQuade on Ellice, and essentially goes on to disparage me, call me a racist, and that I made fun of him for a speech impediment that he carries, which, again, is just something that I -- I haven't or would not do. And then the culmination of that is that he also has a blog that he posts a lot of written posts to where he took photos of another staff member and used AI to, I don't know, change the way they look, I suppose, and have those photos go along with his post, including he took screenshots of some of my photos from social media and used AI to -- to render new photos of me and make it look as though he and I are in the store together to go along with this post. And this is something that, again, I will say it's my day off today. I actually -- I was outside earlier waiting here. My manager phoned me to let me know that he had done this because I -- I wasn't aware of that.

Well, that's when I was informed about it. Yeah. Yeah. All -- that's the nature of all of this. I didn't know that these YouTube videos were being posted or that the LinkedIn posts existed for, like I said, around a month or two.

And then I was made aware of it, and it's been about a week that I -- that I've seen what has been going on.

Yeah. And Tyler lets everybody know about that as well because he posts screenshots of the email between him and the -- I believe it's the president of the company that he interacts with, and he posts screenshots of their emails back and forth to his YouTube channel.

Okay. And -- and this is the same when you say here, "for non-existing discriminatory treatment", this is still stemming from that one incident where you said his guitar didn't need to be fixed --

That's the -- the -- that -- that is the first and last face-to-face interaction he and I have had, and the only online interaction we've had was the line of commenting on LinkedIn from yesterday that I had mentioned.

Where you work. So you've indicated he's now harassing colleagues on the phone when you're away?

Well, he calls or he has someone else call on his behalf, and they claim to be either, you know, a girlfriend or some other relation with him. And they get through to management, and they try to log complaints against the applicant, myself, for racial treatment of Tyler and online harassment of Tyler.

All right. But he never comes into the store when you're there?

I have -- I've seen him in the store once, but I didn't interact with him. He was in our rentals department. I was informed that he had a rental out with us in the last week, and I was only informed of that because a colleague felt it was appropriate to let me know just in case I did see him again, that I could avoid him.

Okay. And so you saw him in the store. He didn't come up to you or anything like that?

No. He didn't see me. I was walking behind who I believed to be him and was later told was him.

So tell me a little bit here when you're saying that the -- he's -- you don't need to tell me about the less reasonable with each interaction -- so he's also not only calling your work or getting individuals to call your work, how's he getting people, acquaintances, to harass your wife?

Well, no, sorry. So that was coupled with they're -- they're harassing my workplace and they're -- they're -- she can see that his friends and people he's connected with are actively looking at her social media every day.

They haven't done anything yet to her, but she showed me and asked me, Is this the gentleman that you told me about from your work? And I said, Yeah. That's him. So I'm not sure how he discovered the connection but -- yeah.

They've had some calls with our management about this situation because he now patronizes their storefront and has had some kind of difficult interactions with them as well. So they've had some communication with our store to get some more context about what might be happening with this customer.

So there's criteria that must be met in order for a protection order to be granted, okay? On a balance of probabilities, more likely than not, I have to be satisfied that the respondent is -- clearly, we're not going to talk about the domestic violence because it's clearly not domestic violence. It's a stalking situation that you're making this application under, so it's the provision of the stalking portion of the Act. So I have to be satisfied that the respondent's stalking or has stalked the subject, that the subject believes that the respondent will continue or resume the stalking, that the subject requires protection because there is a reasonable likelihood that the respondent will continue or resume the stalking, and that due to the seriousness or urgency of the circumstances, that a protection order should be made without delay. All right. So for me to consider -- and I'll just indicate here on the record that the definition of stalking in this Act is: (as read) Stalking occurs when a person, without lawful excuse or authority and knowing that another person is harassed or recklessly as to whether the other person is harassed, repeatedly engages in conduct that causes the other person reasonably, in all circumstances, to fear for their own safety. And so I think the question here is the "fear to (sic) their own safety". I don't know if you have a personal fear of this individual.

He says it's because of your discrimination to -- to whatever race he is. You've indicated that he says that you were discriminatory because of -- or you're racist. He then started tagging you on -- on things on different apps, LinkedIn. He's uploading YouTube videos. You've even indicated that he's taken photos off the internet and -- and generated photos using AI.

-- as well. So it -- it -- I mean, he's -- he's using all of the tools that are available to a person to, you know, harass an individual. For what purpose, I -- I still -- I'm unclear as to the -- the reasonings why, what -- what the circumstances were. But I'm just going to go over all of those criteria that have to be met, okay? So the first criteria again, I have to be satisfied the -- that the respondent is stalking or has stalked the subject, and when I told you the -- the examples of conduct in that harassment, I -- I can definitely make a finding. He might not be following you from place to place or he might not be following somebody that you know from place to place, but he is either communicating directly or indirectly. He's contacting other people that you are -- you have a relationship with, either your work, he's -- you see that he's following you, however that social media works, where you see that he's looking at your profile on Instagram or whatever app that is. So he might, you know -- he's also using the internet or electronic means. He's harassing you in that way. You know, using your full name. He posted your IP address online, also the business in which you work, and using disparaging comments on the internet. So I can definitely make a finding that there is some level of stalking here, all right? You -- you're making this application here. So you, the subject -- you do believe that it will continue or resume, otherwise you wouldn't be here. If --

The next part of the test is that the Court can make a finding that the -- that you require protection because it will continue or resume or because there's a reasonable likelihood. And I think, clearly, again, this all stems from one incident from two months ago, and it seems that it started when he walked out the door that day and hasn't stopped. You know, the -- the comment, that "Oh, you don't know what's coming", I think could be considered threatening.

That you could have a fear. You know, so in those circumstances, I believe that you do require protection because there's a reasonable likelihood that they will continue or resume. There's the final part of the test is that due to the seriousness or urgency of the circumstances, that a protection order should be made without delay. Again, even -- even though it's not a circumstance where the stalking is personal, where -- it's not like he's following you and you have a fear in -- in that sense. I think there's definitely a fear here. He's, you know -- he's using your personal information. He's, kind of, throwing it out there for people, anybody. You know, he's now enlisting the help of other people to disparage your name. So I do -- I do feel that there are -- there is seriousness or urgency in these circumstances. So I -- I am prepared to grant your application here today. So there are conditions, and we're going to go over those conditions right now. It's in effect starting today, so that's July 22nd, 2026. So the expiry date will be July 22nd, 2029, okay?
